@ LILBRO1062000: well it’s not wrong to change the firmware to suit yourself, but think about what the pirates are doing. They are modding the console to suit themselves, and still using it to go online. It’s like using a pirated product and going online to allow them to detect that you are using a fake copy etc.

While I have nothing against piracy and Xbox and whatever, I do find that Microsoft did the right thing in banning the pirates. You should know that you shouldn’t connect online when you are using a pirated product!

If I put a new stereo in my car does that make me a criminal? If I modify the engine does that kill? If I take apart my xbox and shove it piece by piece up my >>>>? It is no one’s business but mine unless you live in a socialist or communist country I do not or at least it is not one yet. Does anyone think before they say anything? Corporations that miss use money and power to influence politics and copyright laws will kill for a profit. Wal-shop owning 49% of a child labor factory in china not illegal and is in no way responsible for that company’s actions if not in direct management but non the less killing and maiming real people. Microsoft practices anti competitive actions all the time in almost every country just Google it, EU still has them in court. They care nothing about laws and will manipulate any government with money to change laws look at the USA’s new copyright protection laws did anyone but a bunch of companies have any input. Government for the Corporation of the Corporation by the Corporation and please don’t be so dumb to think that this is D or R rant they both live for the money and the power not the people. Piracy is freedom so please support you local pirate and long live the free people, the rest can live in the comforter of a corporations guarantee.

The irony of some comments posted here here is rather stunning. Let’s get one fact straight here:

Stealing is wrong, period. No one disputes the fact that shoplifting could get you thrown behind bars, yet stealing software is suddenly A OK and you get pissed at them letting you go lightly? There was a case where a college student was fined 700k for downloading music a while back.

I know for a fact that if someone steals all of my school notes my immediate reaction would be to lacerate that person with my shinai without a care of how many splinters I leave in him and how many shinais I end up breaking (kendo practioners carry spares at all times anyway) and worry about what happens later.

That is all. To those who are whining. THINK, THINK for one god damned second. This is beyond what facepalming can express. WOW. Be glad MS isn’t actually filing lawsuits. If you really have the balls, go file a lawsuit against MS, let me know so I can finally have an excuse to watch TV.

legally, your ass belongs to them if you break their terms. of course, thousands of people could challenge this in court but i doubt they’ll win. not to mention, the district attorneys of the United States would be prosecuting them if it was really illegal. seeing as the issue is fairly new, that could happen (the issue is very sticky, just as internet regulation is very sticky) but it probably won’t. legal interpretation of that contract says otherwise. you breach the contract you agree to, you are bound to the terms of violation stated in that contract. ignorance is no defense. you can’t argue that they had no right when you said they do.

The fact is, you can be as angry at pirates as you want. You can say, oh ban these cheats, kill them all, ra ra ra……but you forget one thing….disabling the hardware itself from features NOT COVERED IN THE TERMS OF USE I RELATION TO LIVE is ILLEGAL!

You can can someone from Live! sure. That is your service and you make it clear when they sign up they can be banned.
BUT YOU CANNOT physically cripple the hardware from NON LIVE RELATED FEATURES.
Nowhere in the TOS does it state they can cripple hardware.

curiosity? how many people buy consoles so they can look at the insides? those that do have no reason to go online with it. And those who go online with it, more than 95% of the time are looking to pirate games and play them on an official server. if you want to change the firmware or OS, that’s your business. but going online with a hacked/modded console is a completely different story. especially since going online and playing with others would be unfair, since the service is supposed to connect consoles that are not modded.

xbox live has terms of service as well, which is a legally binding contract that consumers agree to. you should be lucky they aren’t taking to lawsuits on individuals.
